Article 1: General provisions

The e-commerce website of Antoinette, a one-man business with its registered office at Hopland 19 bus 8, 2000 Antwerp and commercial headquarters at Lange Koepoortstraat 72, 2000 Antwerp, VAT BE 0683.659.859, RPR, offers its customers the opportunity to purchase the products from its webshop online.

 

These General Terms and Conditions (‘Terms and Conditions’) apply to any order placed by a visitor to this e-commerce website (‘Customer’). When placing an order through Antoinette's online shop, the Customer must expressly accept these Conditions, thereby agreeing to the applicability of these Conditions to the exclusion of all other conditions. Additional conditions of the Customer are excluded, except when previously, in writing and expressly accepted by Silke Antoni.

 

Article 2: Price

All prices stated are expressed in EURO, always including VAT and all other duties or taxes to be borne by the Customer.

 

If delivery, reservation or administrative costs are charged, this will be stated separately.

 

The indication of price refers exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes and may contain elements not included in the price.

 

Article 3: Offers

Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up-to-date. Obvious mistakes or errors in the offer do not bind Silke Antoni/Antoinette. With regard to the accuracy and completeness of the information offered, Silke Antoni/Antoinette is only bound by an obligation of means and is under no circumstances liable in the case of obvious material errors, typesetting or printing errors.

 

If the Customer has specific questions about e.g. sizes, colour, availability, delivery period or delivery method, we request the Customer to contact our customer service department in advance.

 

The offer is always valid while stocks last and can be modified or withdrawn by Silke Antoni/Antoinette at any time. Silke Antoni/Antoinette cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.

 

Article 4: Online purchases

The ordering procedure is as follows:

  • the customer selects the desired products and adds them to his/her shopping cart;

  • to order, the customer clicks on the shopping cart icon in the top right corner of the webpage and selects ‘view shopping cart;

  • the customer checks his/her order and selects a pick-up point, here the customer can also add a promotion code or note;

  • the customer clicks on ‘checkout’ to continue the purchase process;

  • here the customer can create an account and has to fill in the personal details and choose a pick-up date as described on the webpage;

  • to continue, the customer clicks on ‘continue';

  • the customer fills in the billing details and clicks on ‘continue';

  • the Customer checks the details and completes the payment, after which he/she receives a confirmation screen and will receive a confirmation e-mail at the indicated e-mail address.

The Customer has the choice between the following payment methods

  • by bank card (Bancontact) or Payconiq

 

Silke Antoni/Antoinette is entitled to refuse an order due to a serious shortcoming of the Customer regarding orders involving the Customer.

 

Article 5: Delivery and execution of the agreement

Collection of the ordered products takes place in Barchel (Van Breestraat 6, 2018 Antwerp) or at the registered office at a mutually agreed time. If the Customer fails to collect the ordered goods at the agreed time, the Customer's right to a refund lapses.

 

 

Any visible damage and/or qualitative deficiency of an article or other shortcoming in the delivery must be reported by the Customer to Silke Antoni without delay.

 

The risk due to loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier was instructed by the Customer to transport the goods and this choice was not offered by the merchant.

 

 

Article 6: Retention of title

The delivered goods remain the exclusive property of Silke Antoni/Antoinette until the moment of full payment by the Customer.

The Customer undertakes, if necessary, to draw the attention of third parties to Silke Antoni/Antoinette's retention of title, e.g. to anyone who might come to seize items not yet paid for in full.

 

 

Article 7: Right of withdrawal

The Customer cannot exercise the right of withdrawal for:

  • the delivery of goods that spoil quickly or have a limited shelf life;

 

Article 8: Warranty

Pursuant to the Act of 21 September 2004 on consumer protection in the sale of consumer goods, consumers have legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

 

To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.

 

If a defect is detected, the Customer must inform Silke Antoni/Antoinette as soon as possible. In any case, any defect must be reported by the Customer within a period of 2 months of its discovery. After this, any right to repair or replacement expires.

 

The legal guarantee never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, modifications or alterations to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

 

Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, subject to proof to the contrary by the Customer.

Article 10: Sanctions for non-payment

Without prejudice to the exercise of other rights available to Silke Antoni/Antoinette, in the event of non-payment or late payment, the Customer will be liable, ipso jure and without warning, to pay interest of 10% per annum on the unpaid amount. In addition, the Customer shall be liable ipso jure and without warning to pay a fixed compensation of 10% on the amount concerned, with a minimum of €25 per invoice.

 

Without prejudice to the foregoing, Silke Antoni/Antoinette reserves the right to take back items which have not been paid for (in full).

 

Article 11: Infringement of validity - non-fulfilment

If any provision of these Conditions is declared invalid, unlawful or null and void, this will in no way affect the validity, legality and applicability of the other provisions.

 

The failure at any time by Silke Antoni/Antoinette to enforce any of the rights enumerated in these Conditions, or to exercise any right thereof, shall never be deemed a waiver of such provision and shall never affect the validity of such rights.

 

Article 12: Modification of conditions

These Conditions are supplemented by other conditions explicitly referred to, and the general terms and conditions of sale of Silke Antoni/Antoinette. In the event of contradiction, these Conditions take precedence.

 

Article 13: Proof

The Customer accepts that electronic communications and backups may serve as evidence.

 

Article 14: Applicable law - Disputes

Belgian law is applicable, with the exception of the provisions of international private law on applicable law.

 

The courts of the Consumer's domicile have jurisdiction in the event of legal disputes. The Consumer can also turn to the ODR platform(http://ec.europa.eu/consumers/odr/).
